What Is A QDRO?
The term “QDRO” is short for “Qualified Domestic Relations Order.” It is a court order that assigns to an “alternate payee” (the former spouse) the right to receive a portion of or all of a retirement plan’s benefits payable to a “participant” (employee). Because it is a technical legal document, it should only be drafted by an experienced attorney who understands the federal law governing QDROs.
Why Do I Need A QDRO?
You will need a QDRO to divide retirement plan benefits – it is the only way to do so. Having your Marriage Settlement Agreement (MSA) speak to the division of a retirement plan is a good start, but it will not divide the retirement plan assets – you must have a QDRO.
